Requisitos
De acordo com o art. 5 da Lei 91/1992, o cônjuge de um cidadão italiano residente fora da Itália, portanto também no Reino Unido, pode solicitar a cidadania italiana após 3 anos da data do casamento ou após 18 meses caso o casal tenha filhos. Desde 11 de fevereiro de 2017, casais do mesmo sexo também podem solicitar a cidadania italiana.
A certidão de casamento precisa estar obrigatoriamente registrada junto às autoridades italianas na Itália antes do início da solicitação. Desde que não haja separação ou divórcio, a cidadania será concedida se o casamento permanecer válido até a assinatura do decreto de concessão da cidadania italiana.
Para poder solicitar a cidadania, é essencial que o requerente nunca tenha:
- Condenações por crimes cuja pena máxima seja superior a 3 anos de prisão;
- Condenações emitidas por autoridades judiciais estrangeiras superiores a um ano por crimes não políticos;
- Condenações por qualquer um dos crimes listados no Livro 2, Título I, itens I, II e III do código penal italiano (crimes contra o Estado);
- Registros relacionados à segurança da República Italiana.
Os requerentes que tenham residência principal no Reino Unido devem possuir uma autorização de residência válida emitida pelo Home Office do Reino Unido, e seus cônjuges italianos devem estar registrados como residentes neste distrito consular (AIRE), além de declarar claramente na solicitação que o cônjuge estrangeiro vive no Reino Unido, especificando o endereço de ambos.
Procedimento
O pedido de cidadania italiana é direcionado ao Ministério do Interior da Itália e deve ser apresentado à missão diplomático-consular responsável caso o requerente resida no exterior. No Reino Unido, a competência do consulado depende da região onde o casal reside.
O requerente deverá fornecer todas as informações solicitadas e toda a documentação necessária para a aplicação. Após o envio e verificação dos documentos, caso esteja tudo correto, o solicitante receberá um número de referência e deverá comparecer a uma entrevista no consulado para verificação de identidade e entrega da documentação original.
Os documentos serão conferidos durante o atendimento e não serão devolvidos, exceto os passaportes e a autorização de residência.
Após a entrega dos documentos originais, o processo de cidadania será administrado pelo Ministério do Interior da Itália. O requerente poderá acompanhar o andamento do processo online.
Com a nova regulamentação introduzida pelo art. 14 do Decreto n.º 113/18, o prazo máximo para emissão da cidadania foi ampliado para até 48 meses a partir da data de envio da solicitação.
Documentação
O que o requerente precisa para iniciar a solicitação:
- Certidão de casamento emitida pelo município italiano;
- Certidão de nascimento completa do requerente, legalizada e traduzida para o italiano (sem prazo de validade);
- Certidão negativa de antecedentes criminais do país de origem e de qualquer outro país, além da Itália, onde tenha residido, incluindo o Reino Unido, legalizada e traduzida para o italiano (válida por 6 meses a partir da emissão);
- Permissão de residência no Reino Unido emitida pelo Home Office;
- Passaportes do requerente e do cônjuge italiano.

My husband is Italian and we have been married for 7 years we also have a son together that was born in Italy. I also have another son from my first marriage. Does he also quality to have Italian citizenship? He is currently in University in South African and is financially dependant on us. We all live in the UK now. I am British and applying for Italian citizenship through marriage. I called the Home Office to ask if there is any way I can get a UK residence permit or proof of my residency, but they said no, because I don’t require one as I have a British passport. The info on the Embassy website clearly states that I need a residence permit, so what do I do? Will they just accept my passport? I don’t want to submit all the other documents they require but be rejected because that one is missing.

Hi, my wife is an italian citizen, we met in the UK, we have 2 children, the first born has italian passport, and the second has a british passport, we got married by proxy, we were in UK but the married was conducted in Gambia, as we are muslims, so the Home office recoginised and accepted our marriage, therefore granting me a residence card.
